Because we have obligations to our soldiers. They are subject to our system of military justice, but they are not beyond the protection of our laws.
I have serious reservations about both the morality and effecacy (except for recividism) of the death penalty. However, I doubt they will receive it, and if they do, it should make for lively debate in the '08 campaign.
How about this for a bumper sticker? 'Support our Troops; Commute their Death Sentence'

How does the law work. I presume there is some rougher military justice that applies. They could not be spared on the grounds their home state does not use the death penalty, right?
I know the Nazis at Nuremberg were mostly hanged, but I don't know if that same penalty still applies. Europeans now consider the death penalty with as much horror as witch burning.
